A. Our Company takes Client privacy seriously and takes reasonable efforts to protect your privacy. We have created this Privacy Policy (“Policies”) in order to share with you our information collection and use practices. Please read these Policies carefully before sharing any personally identifiable information described below.

II. DEFINITIONS

The following words used in these Policies shall have the following meanings:

“Personal Information” shall mean all data and/or information provided by and about Client.

“Web Site” shall mean all web sites on which Company provides products and/or services, either now or in the future.

“Client” shall mean all registered Clients of Company.

“Products and Services” shall mean all products and/or services provided by Company.

“Registration Information” shall mean the Personal Information you are required to give to Company in the registration process, in order to access our products and services.

III. WHAT PERSONALLY IDENTIFIABLE INFORMATION DOES COMPANY COLLECT AND HOW IS IT USED?

A. In order to use these services of Company, you will be asked for, or you may choose to provide, certain personally identifiable information such as name, email address, postal address, company name, primary contact name, bank account or credit card and other information.

B. Company will not collect personally identifiable information from you while you use the website or services unless you voluntarily provide it to us or authorize us to collect such information.

C. Company may use or disclose personally identifiable information of Client to:

operate and manage the website;

provide services that Client has requested; or

respond to Client’s other inquires or requests.

D. Company may disclose personally identifiable information in the establishment or exercise of legal rights or defenses against legal claims, to comply with applicable laws or regulations, to comply with a valid legal process such as a search warrant, subpoena or court order or to investigate suspected fraud or a violation of our Terms of Use. We will never sell your Personal Information to any third party not affiliated with our Company, without your consent, except in connection with the sale or merger of Company or the division responsible for such services provided.

E. When a Client utilizes Company’s services, Company will collect the content of those communications as well as the content of any other communications between Client and Company.

F. Company may, from time to time, send or post surveys or requests for Client feedback, in order to help us make our website and services better. Any responses Company receives from Client will be used only to evaluate our website and services and no personally-identifiable information from respondent Clients will be shared with any non-employees of Company.

IV. WHAT NON-PERSONALLY IDENTIFIABLE INFORMATION DO WE COLLECT AND HOW IS IT USED?

A. Company does collect and track certain non-personally identifiable information, including, but not limited to, client IP addresses, and browser type, access times, domain names, usage habits and other information which does not specifically identify any individual.

B. Company’s service is provided to monitor and assess ‘Conversion Tracking’ which means we will be collecting data on customers’ usage of Client’s website(s). This means that Client will embed a JavaScript code in their website, which, when triggered by customer usage, sends tracking information to our servers. Each Client gets a different JavaScript tracking code, so no code can be tracked across different Client websites. Company then compiles and assesses the data, having tracked the events and the conversions between events, for Client’s website. This information is only collected in aggregate form and personally identifiable information of any customer of Client’s is not stored.

C. Company may use and disclose non-personally identifiable information for any number of reasons, including but not limited to, working with business partners and improving our website and services.

V. DOES COMPANY HAVE A NEWSLETTER?

A. Company may send out newsletters or weekly status emails to Clients. In these newsletters and e-mails, we may inform you about new features being added to our services. Company may also provide you with specific personal statistics from the respective past calendar week (i.e. the number of hits and website usage by customers on your website, etc.).

B. You may choose to unsubscribe from the newsletter at any time by sending an email to the link provided at the end of each newsletter.

VI. DOES COMPANY USE COOKIES AND WEB BEACONS?

A. Cookies are small text files that a website can write to your computer. Web beacons are often-transparent graphic images, usually no larger than a 1×1 pixel that are placed on a web page or in an e-mail, used to monitor the behavior of the Client visiting the website or receiving the e-mail. Company may use cookies and Web Beacons to identify you and allow you to log in once to our website.

B. Cookies are also used by our affiliates to identify you as a Client of Company.

C. Company does not use Cookies or Web Beacons to store information such as credit card numbers, telephone numbers, or other information you provide. To maintain your privacy, you can disable your browser’s ability to accept Cookies.

D. This Policy covers the use of Cookies and Web Beacons by Company. It does not cover the use of Cookies or Web Beacons by any other third party or advertiser.

VII. IS MY INFORMATION PRIVATE WITH COMPANY’S ADVERTISERS?

A. Company website may contain links to other third-party advertiser websites. Each of these websites may have a Privacy Policy that differs from that of Company’s. The privacy practices of other websites linked to us are not covered by this Privacy Policy.

B. No Personal Client Information will be shared between Company and one of our advertisers.

VIII. WHAT ABOUT DATA SECURITY?

A. Company has instituted appropriate security measures that protect against the loss, misuse or alteration of information that we have collected from Clients.

B. Company limits access to personal information about Client to employees for whom we reasonably believe it is necessary, in order to provide products or services to you.

C. Company has physical, electronic and procedural safeguards that comply with international regulations to protect against the loss, misuse or alteration of information that we have collected from Client at our website. We encrypt all sensitive personal information using Secure Socket Layer technology (SSL).

IX. MAY I SEE THE INFORMATION YOU COLLECT ABOUT ME?

Yes! We provide you with access to your personal account information (e.g., customer number, etc.), account status, contact information (i.e., name, address, telephone number, etc.) and other information that you may access by logging into your account or by emailing Customer Support. We will respond within 24 hours.

X. WHERE IS THE WEB SITE LOCATED?

Company’s website is maintained from within the United States. If you are located outside of the United States, by using our website, you authorize the export of personally identifiable information to the United States and its storage and use as specified in thesePolicies.

XI. WILL THERE BE CHANGES TO THESE POLICIES?

A. Company reserves the right to amend these Policies at any time, in the event that this becomes necessary after their initial release, or in the event that it becomes necessary with respect to additional or amended services provided by Company.

B. Company will not personally notify you of any amendments to these Policies. Clients are urged to check these Policies frequently in order to determine whether any changes have been made. Client understands and agrees that continued use of the Company website and services assumes that Client has read and accepted these Policies, as amended from time to time.

XII. SECTION TITLES

The section titles used in these Policies are purely for convenience and carry with them no legal or contractual effect.
